NALSC’s Board of Directors approved a new provision to its Code of Ethics. This new provision states:

“The names of attorneys received from an employer as ‘off-limits’ in the context of a search shall not be used by a search firm to solicit said attorneys. This shall not prohibit solicitation based on a search firm’s independent knowledge of, or relationship with, a candidate provided such solicitation is not derived from the off-limits list.”

This is found in Article 1 (Relations with Employers), Section 7.

The purpose of this provision is to strengthen the confidentiality of information that law firms may share with NALSC recruiters in connection with targeted searches, and to prevent misuse of information by search firms outside the purpose from which it was provided.
